Terms of Service
Below are the terms of service which must be agreed upon in order to conduct any in-home tech support, computer coaching, or cybersecurity mitigation.
CozyTech, LLC Service Agreement
This Service Agreement ("Agreement") is made between CozyTech, LLC ("CozyTech") and the Customer ("you"). By accepting CozyTech's services, you agree to the terms outlined below.
1. Scope of Services
CozyTech provides in-home technology support, troubleshooting, hardware/software upgrades, consultations, computer coaching, and cybersecurity services. We strive to resolve technical issues with skill and good faith. However, certain services—such as network cabling, or hardware replacement—may be outside the scope of CozyTech’s offerings.
2. Customer Responsibilities and Backup Services
Customers must back up all data before service begins unless backup services are explicitly purchased from CozyTech. We will make a best effort to secure your data, but we cannot guarantee successful recovery. CozyTech is not liable for data loss, even during backup services, if recovery is not possible due to pre-existing corruption or hardware failure.
3. Malware, Corruption, and Data Loss
While CozyTech will attempt to remove malware or fix corrupt systems, some situations (e.g., ransomware) may necessitate wiping the device or reinstalling the operating system. In these cases, data loss may be unavoidable, and CozyTech will not be held responsible for such loss. We will communicate risks transparently and proceed with your acknowledgment.
4. Best Effort Clause and Service Limitations
CozyTech commits to providing best-effort services. However, certain issues may not be resolvable due to technological limitations or customer choices (e.g., refusing necessary hardware replacements). In such cases, CozyTech will charge for time spent diagnosing and attempting repairs, even if a full resolution is not possible.
5. Booking Fees and Cancellation Policy
Booking fees cover our travel and the initial diagnostic assessment. They are non-refundable, even if you choose to cancel or reschedule. Once a diagnosis has been made and agreed upon, hourly service charges will commence. No refunds will be issued for services provided.
6. Indemnification and Good Faith Effort
CozyTech provides services in good faith, aiming to resolve issues with care and professionalism. However, the Customer agrees to indemnify and hold CozyTech harmless from any claims, damages, or liabilities arising from service outcomes. Some losses (e.g., data loss, cybersecurity breaches) may occur despite diligent efforts, and CozyTech cannot be held responsible for such unavoidable circumstances.
7. Authorization for Account Management Activities
By requesting CozyTech to perform account management activities (such as password changes, enabling multi-factor authentication, updating email addresses, or similar actions), you affirm that CozyTech is acting as an authorized extension of you for the duration of these activities. CozyTech operates under your direction and authority as if you were performing these actions yourself. You acknowledge that CozyTech does not assume ownership or ongoing responsibility for the accounts or their use beyond the agreed-upon service period.
CozyTech is not liable for any disputes, complications, or changes of heart that may arise from these account management actions, including but not limited to conflicts with other individuals who share access to the affected accounts. Customers are responsible for informing all account users of changes, where applicable, and resolving any related conflicts independently.
8. Refund Policy
Refunds are not available for services rendered. The Customer acknowledges that CozyTech’s efforts are subject to limitations, and payment is due for labor performed, regardless of outcome. Exceptions may be made only as required by law.
9. Insurance and Third-Party Products
CozyTech maintains business insurance for coverage in the event of damages or liability. Additionally, CozyTech may recommend third-party products (e.g., hardware) and offer them for sale. Any products purchased are subject to the manufacturer's terms and warranties.
10. Governing Law
This Agreement is governed by Ohio law. Any disputes will be resolved in Ohio state courts.
11. Termination of Services
CozyTech reserves the right to terminate services if the Customer engages in inappropriate behavior or refuses necessary safety recommendations. No refunds will be issued in such cases.
